Welcome to Artistech. The terms “we,” “us,” and “our” refer to Artistech, operating under PG Creative Studio Inc.

Artistech operates this website and online store, including all related information, content, features, tools, products, digital products, educational resources, and services (collectively, the “Services”). Our Website and online store are powered by Shopify, which enables us to provide certain Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you access our Website, purchase our products, or use our Services.

Please read these Terms carefully. By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy, Refund Policy, and Website Disclaimer.

If you do not agree with these Terms, you should not access or use our Services.

Custom client projects may also be subject to a separate proposal, contract, statement of work, or service agreement. If there is a conflict between these Terms and a signed client agreement, the signed client agreement will govern with respect to that project.

SECTION 1 – ACCESS AND ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your province, state, or country of residence, or that you have obtained any consent legally required to use the Services.

To access certain Services or make purchases, you may be required to provide information such as your name, email address, billing information, payment information, or other account information.

You represent that the information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You may not sell, transfer, assign, or provide unauthorized access to your account.

SECTION 2 – PRODUCTS, DIGITAL PRODUCTS & SERVICES

Artistech may offer products and services including, but not limited to:

  • website design and development;

  • branding and creative services;

  • e-commerce services;

  • digital strategy and consulting;

  • marketing and search engine optimization services;

  • courses and educational programs;

  • live and recorded workshops;

  • guidebooks and e-books;

  • templates and digital downloads;

  • tutorials, training materials, and other educational resources; and

  • other creative, digital, or educational products and services.

We make reasonable efforts to accurately describe our offerings. However, descriptions, features, pricing, availability, and other information may change from time to time.

We reserve the right to modify or discontinue any product or service and to limit availability by person, geographic region, jurisdiction, or other reasonable criteria.

Any specific terms presented on a product, course, workshop, or service page at the time of purchase form part of your agreement with us.

SECTION 3 – CUSTOM CLIENT SERVICES

Custom client engagements are governed by the applicable proposal, contract, statement of work, or service agreement entered into between Artistech and the client.

These agreements may establish project-specific terms relating to scope, deliverables, fees, payment schedules, revisions, timelines, client responsibilities, intellectual property, cancellation, rescheduling, termination, and refunds.

Where a signed client agreement conflicts with these general Terms, the signed client agreement will govern with respect to that engagement.

Information provided on the Website regarding our services, packages, pricing, processes, or timelines is general in nature unless expressly incorporated into a client agreement.

SECTION 4 – ORDERS AND PURCHASES

When you place an order through our Website, you are making an offer to purchase the applicable product or service.

Artistech reserves the right to accept, reject, limit, or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing or availability errors, unauthorized transactions, or violations of these Terms.

Payment must be successfully processed before an order is considered complete unless otherwise agreed.

Please review your order carefully before submitting it. Certain digital products may be delivered or made accessible immediately, which may limit our ability to cancel an order after purchase.

Purchases are subject to our Refund Policy and any additional terms disclosed at the time of purchase.

Unless expressly permitted, purchasing a product does not give you the right to resell, redistribute, sublicense, share, reproduce, or otherwise commercially exploit it.

SECTION 5 – PRICES, BILLING & TAXES

Prices, discounts, and promotions are subject to change without notice.

The price applicable to your purchase will generally be the price displayed at the time the order is placed, subject to correction of obvious errors.

Unless otherwise stated, prices may not include applicable taxes, duties, currency conversion charges, or other fees.

You agree to provide current, complete, and accurate billing and payment information and represent that you are authorized to use the payment method provided.

Custom client services may have separate pricing and payment schedules established through the applicable client agreement.

SECTION 6 – DIGITAL PRODUCTS, COURSES & EDUCATIONAL MATERIALS

Purchasing or accessing a course, workshop, guidebook, template, digital download, tutorial, or other educational resource gives you a limited right to use that material in accordance with these Terms and any product-specific license provided at the time of purchase.

Unless expressly stated otherwise, educational and digital products are licensed to the purchaser for individual or internal business use only.

You may not, without our prior written permission:

  • share login credentials or paid access with unauthorized users;

  • copy or distribute course materials;

  • reproduce or republish guidebooks or educational content;

  • resell or sublicense templates or downloads;

  • upload paid materials to publicly accessible websites, platforms, databases, or file-sharing services;

  • use our materials to create substantially similar products for resale; or

  • otherwise commercially exploit Artistech intellectual property beyond the rights expressly granted to you.

Specific products may include broader commercial-use licenses. Where such a license is expressly provided, its terms will govern your use of that product.

SECTION 7 – WORKSHOPS & LIVE EVENTS

Registration for workshops, classes, webinars, or other live events may be subject to additional terms regarding attendance, rescheduling, cancellation, recordings, and access to materials.

Artistech does not guarantee that recordings or replays will be available unless expressly stated as part of the purchase.

If a workshop includes guest speakers or contributors, their opinions and recommendations are their own and do not necessarily represent those of Artistech.

Cancellation and refund eligibility for workshops is governed by our Refund Policy and any event-specific terms disclosed at registration.

SECTION 8 – SHIPPING & PHYSICAL PRODUCTS

If Artistech offers physical products, shipping and delivery times are estimates and are not guaranteed unless expressly stated otherwise.

We are not responsible for delays caused by carriers, customs authorities, incorrect delivery information provided by the customer, or circumstances outside our reasonable control.

Additional shipping, customs, duties, taxes, or import fees may apply depending on your location.

This section does not apply to digital products or custom client services.

SECTION 9 – INTELLECTUAL PROPERTY

The Website and Artistech's original content—including our trademarks, branding, text, graphics, photographs, illustrations, videos, course materials, guidebooks, templates, downloads, tutorials, frameworks, educational resources, and the design and arrangement of such materials—are owned by or licensed to Artistech and are protected by applicable intellectual property laws.

Except for rights expressly granted under these Terms or a separate written agreement, nothing grants you ownership or other rights in Artistech's intellectual property.

You may not reproduce, distribute, modify, republish, sell, sublicense, publicly display, commercially exploit, or create unauthorized derivative works from our materials.

Client-specific intellectual property rights are governed by the applicable client agreement.

Third-party trademarks, photographs, artwork, fonts, software, and other third-party materials remain the property of their respective owners.

SECTION 10 – OPTIONAL TOOLS & THIRD-PARTY SERVICES

We may provide access to or recommend third-party tools, software, platforms, plugins, applications, hosting services, payment processors, marketing tools, or other resources.

These third-party services are provided independently of Artistech and may be subject to separate terms, privacy policies, fees, and conditions.

To the extent permitted by applicable law, Artistech is not responsible for the availability, performance, security, functionality, pricing, policies, changes, or actions of third-party providers.

You are responsible for reviewing and accepting the applicable third-party terms before using their services.

SECTION 11 – THIRD-PARTY LINKS

Our Website, products, courses, or educational resources may contain links to third-party websites.

We are not responsible for examining or evaluating the accuracy, content, security, privacy practices, products, or services offered through third-party websites.

Your use of third-party websites and services is at your own discretion and subject to their applicable terms and policies.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

Artistech is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Artistech.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Artistech, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Artistech, to the extent permitted by applicable law.

SECTION 13 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our Website and store are hosted by Shopify, Shopify may collect and process certain personal information in connection with your access to and use of the Services.

Information may also be processed by payment processors, email platforms, analytics providers, and other service providers used to operate our business.

SECTION 14 – FEEDBACK, REVIEWS & SUBMISSIONS

If you voluntarily submit feedback, suggestions, ideas, reviews, comments, or other materials to Artistech, you represent that you have the right to provide them and that they do not infringe the rights of another person.

Unless otherwise agreed, you grant Artistech a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display voluntarily submitted reviews and feedback for legitimate business and promotional purposes.

We will not knowingly attribute private communications or confidential client information to you publicly without appropriate permission.

SECTION 15 – ERRORS, INACCURACIES & OMISSIONS

Occasionally, information on the Website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, or other information.

We reserve the right to correct errors, update information, or cancel an affected order where reasonably necessary.

If an error materially affects a completed purchase, we will address the matter in accordance with applicable law and our Refund Policy.

You may not use automated systems, scraping tools, bots, autonomous agents, artificial intelligence systems, or similar technologies to systematically access, extract, reproduce, train on, republish, or commercially exploit Website content or paid Artistech materials without our prior written permission, except where such activity cannot lawfully be restricted.

We may implement technical measures to restrict or manage automated access to the Services.

SECTION 18 – NO GUARANTEE OF RESULTS

Artistech does not guarantee any particular business, financial, creative, marketing, or other result arising from the use of our Services, products, courses, workshops, templates, guidebooks, or educational resources.

Results depend on numerous factors outside our control, including your circumstances, implementation, business, audience, market, effort, experience, and third-party platforms.

SECTION 19 – TERMINATION

We may suspend or terminate your access to the Services where reasonably necessary, including where you materially violate these Terms, misuse our intellectual property, engage in fraudulent or unlawful conduct, or compromise the security or operation of the Services.

Termination does not eliminate payment obligations or other liabilities incurred before termination.

Provisions that by their nature should survive termination—including intellectual property, payment obligations, limitation of liability, indemnification, and governing law—will continue to apply.

SECTION 20 – DISCLAIMER OF WARRANTIES

To the extent permitted by applicable law, the Website and its general content are provided on an “as is” and “as available” basis.

We do not guarantee that the Website will always be uninterrupted, timely, secure, or error-free.

Any warranties or commitments relating specifically to custom client services are governed by the applicable client agreement.

SECTION 21 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Artistech and its owners, directors, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, consequential, or similar damages arising from your use of the Website, digital products, educational resources, or Services, including lost profits, lost revenue, lost savings, or loss of data.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Liability relating specifically to custom client services is governed by the applicable client agreement.

SECTION 22 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Artistech and its owners, directors, employees, contractors, agents, and affiliates from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:

  1. your material breach of these Terms;

  2. your violation of applicable law;

  3. your infringement of another person's rights; or

  4. your unauthorized or unlawful use of the Services or Artistech materials.

SECTION 23 – SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in effect.

SECTION 24 – WAIVER & ENTIRE AGREEMENT

Our failure to exercise or enforce a provision of these Terms does not constitute a waiver of that provision.

These Terms, together with the policies and terms incorporated by reference, constitute the agreement governing your general use of the Website and purchases made through it.

Separate signed client agreements govern the applicable custom client engagement and will prevail over these Terms where there is a conflict relating to that engagement.

SECTION 25 – ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations where reasonably necessary in connection with a reorganization, sale, merger, transfer of business, or similar transaction, subject to applicable law.

SECTION 26 – GOVERNING LAW

These Terms and your use of the Website are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Nothing in these Terms is intended to limit any rights or remedies available to you under applicable consumer protection legislation or other laws that cannot be waived by agreement.

SECTION 27 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices, technologies, or legal requirements.

The current version will be available on this page with its applicable “Last updated” date.

Where required by applicable law, we will provide notice of material changes.
